2. Services / Products

FLX ProHost LLC provides short-term rental (STR) co-hosting and property management services to property owners ("Owners"). Our services may include, without limitation: listing creation and optimization on short-term rental platforms (e.g., Airbnb, Vrbo, Booking.com); guest communication and booking coordination; pricing and calendar management; coordination of cleaning, turnover, and maintenance services; guest screening and check-in/check-out support; and other property management support as agreed with the Owner.

Specific scope of services, fees, and revenue-sharing or management terms for a given property are set out in a separate co-hosting or property management agreement between us and the Owner. These Terms govern use of the Site generally; they do not replace or override the terms of any individual co-hosting or management agreement, which will control in the event of a conflict.

FLX ProHost LLC does not own the properties we manage and we act as an agent/service provider on behalf of Owners in connection with the operation of their short-term rental properties.

3. Intellectual Property
All content on the Site — including text, graphics, logos, images, and software — is owned by or licensed to FLX ProHost LLC and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

4. Chat Widget & Communications
By using the chat widget or submitting a form on the Site, you consent to being contacted by us via the method you provide (email, phone, SMS) regarding your inquiry. Chat and form data is processed by our third-party provider, GoHighLevel/LeadConnector, as described in our Privacy Policy.

5. Third-Party Links and Services
The Site may contain links to third-party websites or services we do not control. We are not responsible for the content, privacy practices, or terms of any third-party sites.

6. Disclaimers
The Site and its content are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee the Site will be error-free, secure, or uninterrupted.

7. Limitation of Liability
To the fullest extent permitted by law, FLX ProHost LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from your use of the Site shall not exceed the amount you paid us, if any, in the twelve (12) months preceding the claim.

8. Indemnification
You agree to indemnify and hold harmless FLX ProHost LLC, its owners, employees, and affiliates from any claims, damages, or expenses arising from your use of the Site or violation of these Terms.

9. Termination
We reserve the right to suspend or terminate your access to the Site at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or the Site.

10. Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Site shall be resolved in the courts located in Steuben County, New York.

We may update these Terms from time to time. The "Last Updated" date reflects the most recent revision. Continued use of the Site after changes constitutes acceptance of the updated Terms.
